Warranty

Only D64 consumer items purchased by the original end-user purchaser (“you”) from D64 or a D64 authorized seller are covered by this guarantee. “D64 consumer products” refers to D64 products made and distributed primarily for individual use by consumers or households (the “Product”) for the purposes of this warranty. This warranty does not apply if you bought the product from a source other than D64 or an authorized D64 seller, or if you bought a non-D64 consumer product. In these cases, you should get in touch with the retailer you bought the item from.

For the duration of the warranty period specified below, D64 warrants that the Product (excluding any third-party software) will be free from material and workmanship flaws when used normally. This warranty does not cover malfunctions or failures brought on by misuse, abuse, neglect, alterations, issues with electrical power, a usage that does not follow the product’s instructions, acts of nature, improper installation, or repairs carried out by anyone other than D64 or a D64 authorized service provider. It also does not cover defects that arise under normal use. The term “original end-user purchaser” as used in this warranty policy does not apply to any purchasers, including but not limited to, people, businesses, and/or other entities who buy and use D64 products in order to profit by enabling people, businesses, or other entities to do the same.

Before returning faulty products to D64 during the applicable warranty period, you must have proof of purchase and obtain warranty service authorization from D64, including a Return Materials Authorization, or RMA, number. The regular RMA Terms and Conditions of D64, which are available online at www.d64international.com/support, apply to all returns. Products being returned must be packaged properly, shipped freight collected, and must be insured or sent using a method that allows for package tracking. Any Product lost or damaged in transit is not D64’s responsibility.

The length of the relevant explicit guarantee is the only limitation on any implied warranties or conditions of merchantability, satisfactory quality, or fitness for a specific purpose. To the maximum extent authorized by law, all other conditions, representations, and warranties express or implied are thus disclaimed, including any implied promise of non-infringement.

Any security measure, including encryption technology, carries inherent risks, and security measures are always susceptible to being thwarted. To the maximum extent permissible by law, D64 disclaims any assurances that your data won’t be accessed by unauthorized parties. D64 cannot and does not provide this guarantee. The following limitation may not apply to you since certain countries do not permit limitations on how long an implied warranty lasts or at all. You have legal rights that are in addition to those provided by this limited warranty and that may vary depending on the jurisdiction. Your statutory rights are unaffected by this restriction.

The product is delivered “AS IS” with all third-party applications. You, and not D64, bear the whole financial responsibility for any necessary service or repairs should the program prove to be of subpar quality, performance, accuracy, or effect.

The use of or inability to use the product shall not, in any event, subject D64 to any liability for lost pictures, data, revenue, or profit, or for any special, indirect, consequential, incidental, or punitive damages, however caused and regardless of the theory of liability, even if D64 has been advised of the possibility of such damages. D64’s responsibility will never go above the price you paid for the goods.

Even if a guarantee or remedy granted by this Agreement fails to fulfill its basic purpose, the aforementioned restrictions will still be in effect. The foregoing limitation or exclusion may not apply to you because some countries do not permit the exclusion or limitation of incidental or consequential damages.
